Article 2 : OBJECT
The present general sales conditions have for object to define the rights and obligations of the parties as part of the selling of online products offered by the seller to the customer. 

These conditions are exclusively for non merchant physical persons. The sale is reserved to legally adults or minors with parental authorization. 

Article 3 : ORDER VALIDATION AND ELECTRONIC SIGNATURE (Law of 13 March 2000 concerning the electronic signature) :  

Every order as a product found on the online shop supposes the consultation and acceptance of the present general sales conditions. The validation click of an order engages a full acceptance of the present parties. 


Article 4: PRICE
All the prices are indicated in euros all taxes included, excluding transportation fees (see paragraph on payment and delivery and time limit modalities). reserves the right to modify its prices at any moment and without warning. The products will be billed on a price base applicable at the moment of the saving of the orders. The products are the property of until the total cashing of the price by the seller. The price is payable fully and in one unique payment. 


The client can order on internet through the website or by telephone from Monday to Friday from 10 am to 1 pm and from 2pm to 6pm at +44 2038 089024. reserves the right to cancel or refuse any order coming from a client with whom a dispute is ongoing, concerning a previous order or which could represent any kind of risk in the eyes of the seller. 

Every order is worth an acceptation of the price and the product description. The seller agrees to honour every received order on the website only in the limit of the available product stock. In case of a lack of availability of one or many ordered products, the seller agrees to inform the client as quick as possible by email. The client's order will be automatically cancelled and the amount will be refunded. 


The payment of the purchases is chosen by the client :

Secure payment by credit card :
You can pay by credit card : in this case the payment is directly done on the website of our bank with our partner Hipay. This implies that none of your private bank information transit on the website The online payment is perfectly secure. Your order will bien registered as soon as your payment will be accepted by the bank service. You can pay online in confidence and enter all your credit card information in the proper boxes.  

Your credit card information are encrypted thanks to the SSL protocol (Secure Socket Layer) and never transit in clear on the network. The payment is directly done towards the bank. In any case the seller has access to all these information, and doesn't keep them on its servers. That's why your bank information are asked everytime you finalize a new purchase. 


Check payment only available in France: 

In case of check payment, it has to be issued by a French bank and at the order MONPETITBIKINI. It has to be sent at MONPETITBIKINI, 352 Chemin de la Nartassière at 06370 Mouans Sartoux

The ordered products are kept for 10 days starting at the day the order is confirmed. Passed this delay and if the check is not received, the seller reserves the right to cancel the client's order. Then, the check will be sent back as soon as received by the company. The cashing of the check is done as soon as received. Checks are not accepted over 99€. 


Paypal payment : doesn't save any detail relative to the bank information of the client. 



Control of regulations : 

The website reserves the rights to control the validity of the payment, before the expedition of the package, by all the means the seller will jugde necessary (especially an ID, proof of residence, etc.). 

Payment default : reserves the right to refuse to send an order or to honour an order of a customer that has not totally or partially paid the previous order or who is in a dispute with the company concerning a payment. In case of fraud or fraud suspition, the seller reserves the right to strike off all member without warning and compensation. 


Article 7 : DELIVERY AND DELAY delivers worldwide. 

In case of mistake while entering your information, especially your delivery address, the seller is not held responsible for the consequences in terms of delay or unavailable delivery. The client has to communicate with a valid email address, for want of these information, will not be responsible for the following consequences. All the fees bound to the reexpedition of the products caused by a client's mistake will be at his own expense. 

Monpetitbikini posts the orders within 24 hours from Monday to Friday. If your order is confirmed before 12.30 pm, it will be sent on the very day. If you order after 12.30 pm, it will be sent the next day. The orders done on Saturday, on Sunday or on a French public holiday will be treated the next working day. 



  • Delivery: package with follow up, delivered within 48 to 72 hours (working days) at 13.90€.  


MONDIAL RELAY (Relay point) delivery: France, Luxembourg, Belgium

The delivery by Mondial Relay is charged 3.5€ at the client. It's free for orders over 60€ (except Corsica). The delivery delay is from 3 to 7 working days and is done in one of our 4300 relay points near your house (supermarket, shops...) 

The package is given to the client after showing is ID. At the shipment of the package an order number is sent by email to the client so that it can be possible to follow the package. 

The package will be available during two weeks at the relay point. After this time, if the client hasn't picked it up, the package will be sent back to the website If the client desires that we send the package again, he will have to pay additional delivery fees. Also 4€ of administrative fees will be added (for the treatment of the return). If the client wants a refund, the administrative fees will be deducted from the amount of the refund. 

Mondial Relay reserves the right to send the client's package to another relay point of the same city if the relay point chosen is closed or not available. The client will then be informed of the changement by email. 

Delivery by COLISSIMO Access, only in France Metropolitan, Andorre, Corsica and Monaco : The price of the delivery for the colissimo service offerd by La Poste is 4.90€ (whatever the size and weight of the package). The delivery by colissimo is free from a 60€ purchase. The delivery time limit is from 48 hours to 72 hours. 

Delivery by COLISSIMO Expert : Monpetitbikini also offers the possibility to choose the Expert service of Colissimo by La Poste which includes an guarantee. In this case, the package is only delivered in exchange of your signature and can't be left in the mail box. The price is 6.5€.  

Express delivery by CHRONOPOST for France Metropolitan : gives their clients the choice of using the service of express delivery, through the La Poste Chronopost service. If your order is finalized before 12.00 pm (working day), you will receive your package before 12.00 pm the next day. If your order is finalized after 12.00 pm, you will receive it two days later. The price of the Chronopost delivery is 9.99€. 


Delivery in the French Islands: The delivery in the French Islands (Martinique, Guadeloupe and Reunion) is done by the service DHL Express. The price of the delivery is 12.50€. The estimated delivery time limit is 1 or 2 working days. Your package will be exchange with your signature. 

For New Caledonia and French Polynesia, the delivery is done by Fedex DOM-TOM who delivers it to you within 1 or 2 working days for the price of 24€

DHL delivery Express America: The delivery towards the United States of America, Canada and Mexico is done by DHL Express. The time limit is 48 to 72 hours (working days) and costs 13€. Your package will only be given to you in exchange of your signature and won't be left in your mail box. Caution, the delivery price doesn't include the customs fees, the delivery time limit can be delayed by customs clearance. 

DHL Express delivery Asia and Africa : For Asian and African countries, DHL Express offers a delivery price of 14.90€ within 1 to 3 working days

Delivery in Europe : For Belgium, Germany, Finland, United Kingdom, Italy, Luxembourg and Netherlands, DHL Express Europe 1 home delivers (signature required) within 24 hours for 13.90€

Delivery in Spain : DHL Express delivers in Spain within a time limit of 24 to 48 hours (signature required) for 13,90€

For Austria, Danemark, Finland, Greece, Ireland, Portugal and Sweden DHL Express Europe 2 home delivers (signature required) within 24 hours, for 13,90€.

For Eastern Europe and Russia, DHL home delivers (signature required) within 1 or 2 working days for 22€

For Switzerland and the rest of Europe, DHL Express delivers (signature required), for 13.90€

Fedex Express World delivery : For the rest of the world, Fedex Express offers a delivery within 1 to 4 working days at your house (signature required) at 24.99€.

For a grouped order, in other words with several articles for a same order, the delivery fees for an article remain the ones mentionned above, the delivery of the rest of the articles from the order is free. 

The haulier time limit indicated above need to be considered starting the moment the package exits our buildings. We decline any responsability about any delays caused by the haulier, especially in case of bad weather, strickes or case of force majeure. 

In case of an extended delay of your delivery of more than 7 days, you will be able to cancel your order. Then, you will be entirely refunded within 30 days, only if you return the article even after receiving it (we agree to pay for the return fees). 

In case of non reception of the package despite the status "delivered" of your delivery follow up, the client can contact at No orders will be refunded if the bad or non execution of the contract is attributable, either at the customer, either of the unpredictable or insuperable of a third party in the contract, either in case of force majeure, according to the article L121-20-3 of the Consuption Code in the French Law. 

All products exit our building in perfect conditions. The client has to report to the haulier (or postman) the minor choc mark (hole, oil stain, etc.) on the package, and can refuse to accept the package. 
The exchange of any product declared, a posteriori, damaged while transportation, will not be exchanged.

Exchanges are possible but remain at your expense for the return ! You can also send back your items for a refund and order again on our website !

According to the articles L.120-20, the customer disposes of a delay of forteen (14) days to return the products he doesn't want to keep. We give you a 15 days delay counting from the day of the package reception. For any return demand, contact us at or at +44 2038 089024.


Exchanging is very simple ! 

If you want to exchange an article, you will have to pay to send it back but we offer the second delivery (except sales items that aren't exchangable). The client disposes of 10 days to send back the products. 

The exchange doesn't imply the reservation of an article. Once the seller has received the returned package for an exchange, some popular products can be not available anymore and the customer won't be able to order it. Then, will suggest another product or a refund.  

Only will be taken back the new products, clean, with the tag still on and in perfect selling conditions. The products have to be tried on with your underwear, the adhesive stipes won't have to be removed. All the products that don't respect this procedure won't be taken back by the company. 

Any product that is damaged, will not be refunded, taken back or exchanged. In this case, no refund can be required, the customer will remain the only owner of the product, that will be sent back to him at his own expense. 

Concerning the brand Too Beach, including in an non-exhaustive way the inflatable buoys, inflatable armbands, inflatable mattresses, beach bags & baskets, beach mats, sunscreen and sun oil, no returns will be accepted. Returns of beach bags and baskets in the category Monpetitbikini will also not be accepted. 

In the hypothesis of the law exercise of retractation, the customer has the choice of demanding eather a refund of the paid amounts or a free exchange of the product.

In the case of the lax exercice of retractation, the seller will make all the efforts to refund the customer in a 30 days delay.  

If the amount of the exchanged order of the client is over the amount of his initial order, he will be able to pay the difference by bank transfer or by PayPal or by check at the folling adress: MONPETITBIKINI, 352 Chemin de la Nartassière a 06370 Mouans Sartoux, FRANCE. The order will be sent as soon as the payment goes through. If the amount of the exchanged order is lower, will pay back the differrence within a 10 working day delay. 


If the client desires a refund of his article, he has to send it back through Post Office or through DHL.

Refund modalities :

In the case of a refund, the return fees are at the client's expenses. 

The refund is done: 

- by credit card for the clients who paid by credit card

- by bank check for the clients who paid this way

- by paypal for the clients who paid by paypal

- by bank transfer for the clients who chose this payment mode (first send us your bank information by email)


No prepaid return coupon will be sent to a client in the case of a contest. If the client won a voucher through a contest, it's non refundable and non exchangable. In this case, the contest's regulation takes precedence over the general sales conditions of the website 


Delivery errors

In the case of a delivery or exchange error, due to a wrong client information (wrong or non existing address), the reexpedition fees are at the client's expenses.  

From the moment the order has been confirmed and paid, the address can't be changed anymore. 


Article 9 : CUSTOMS FEES   

Every order done on the site and which the delivery country is not France can be submitted to customs. These customs rights are imposed by current regulations of the country. These taxesare at the client's coast and reveal from his responsability. doesn't have to verify and inform it's client's of the customs rights and practicle taxes. The client has to inform himself by asking the competent authorities of his country before ordering on the website. In case the client refuses to pay the customs fees or taxes, we are eventually asked to pay the taxes at to collect the package which will be deducted from the amount of refund of the client. The initial delivery fees will also be deducted from the refund amount such as the administrative costs of 3€.  



All the texts, comments, work, illustrations and images reproduced on are reserved by strict copyrights also at the title of intellectual property worldwide. A this title and according to the rights of the intellectual property, are only allowed for a private use, under reserves of different dispostions, more restrictive than the intellectual property code. Every reproduction partial or fully of the website is strictly prohibited unless a preliminary agreement. 



The company only has, for every steps to access the website, of order process, of delivery, of customer service or of posterior services, a best endeavours obligation. The responsability of isn't engaded for all the inconviniences concerning or damages inherent to the use of the internet network, especially a server break down, an external intrusion or the presence of a cumputer hardware virus, or of all fact qualified as major force, according to the jurisprudence. The computerized records kept in the information sorfware of is reasonable security conditions, will be considered as communication evidence, of the orders and payments intervened in between and the client. 


The seller reserves the possibility of adapting or modifying at any moment these general sales conditions. In case of modification, it will be applied to every order the general sales conditions applicable the day of the order. 


All the best efforts have been put in to assure the accuracy of the informations given on the selling website. However the seller and the supplier aren't responsable of the consequences, incidents, special damages resulting from the electonic transmitions or the exactitude of the transmitted information even in the case where the seller  knew the possibility of these damages. The names and brands of products and companies are only used in an identification goal. 


Article 14 : APPLICABLE LAW 
The present general conditions are submitted to the french law. It's done this way for the rules of style and content. 

In case of litigation or of claim, the customer will first speak to the seller to obtain an amicable solution. 



All the information you give us are used to process your orders. 

In vertue of the french law n°78-17 of January 6th 1978 relative to data processing, at the files and at the liberties, you dispose of a rectification, consultation or modification right towords the seller and of cancellation of the personnal information you gave us. This right can also be practiced online. 

The dispositions of the présent object can't deprive the customer from the legal warranty which forces the professional seller to warranty it against all the consequences of hiden deviousness against the sold thing. 

The customer is well aware than the seller isn't the manufacturer of the presented products on the website and that the seller isn't in any case responsible of faulty products. 

By consequence, in cas of harm caused to a person or to a good by a faulty product, only the manufacturers responsability about this specific product is engaged and can be searched by the customer, on a basis of the informations on the product's packaging. 


Article 17 : USE RIGHTS 
L’utilisation des marques présentes sur le site est strictement interdite. The use of the brands present on the website are strictly prohibited. 


Article 18 : FORCE MAJEURE
Any parties will have failled to their agreement obligations, if their exectution is delayed, hampered or help up by a fortuitous case of force majeure. Will be considered a case of force majeure all irresistible case or circumstance, external to both parties, inpredictable, inevitable from the parties will and won't be able to be stop par them, despite all their reasonable possible efforts. 

The affected part by these circumstances will have to advice the other part within a delay of ten working days following the day he found out about the problem. 

The two parties will then get together, within a three month delay, unless impossibility due to the force majeure, to examine the incident of the event and agree on the way the contract will be pursued. 

If the force majeure case lasts more than one month, the present general conditions can be canceled by the injured partie. 

In an easier way, will be considered force majeure cases or fortuitous cases, other than the ones who are usually held by the jurisprudence of the french courts: an obstruction of all transportation ways, earthquake, fire, storm, flood, telecommunication networks stop working, wars,...


Article 19 : Partial invalidity 
If one or many stiputations of the present general conditions are held for non valid or declared as such in a law application, of a regulation, or after a definitive decision of a competent jurisdiction, the other stipulations will keep their force and their reach. 


Article 20 : Non-renunciation 

The fact for one of the parties of not prevail of a breach by the other part at any aimed obligation in these present general sales conditions can't be interpretered for the future as a demand in a cause obligation.  


Article 21 : Litigation's responsability is, in any case, limited to the amount of the order and can't be held responsible for simple mistakes or omissions which could have existed despite all the precautions taken in the product's presentation. 

Monpetitbikini won't be held responsible, towards a client or a third party, of any indirect damage, of any exploitation lost or turnover profit lost, occurred by any way, even if the damage, lost or prejudice was predictable by Monpetitbikini, or if this event caught its attention.
